¿Cómo prevenir la Biopiratería en el Perú? Reflexiones y Propuestas.

The subject of Biopiracy has become today an increasing and recurrent phenomenon that has important social, cultural, economic, political and legal consequences. For that reason, it has waked up great debate and controversy in diverse international forums in the last years. Bipiracy generally is defined as the access and nonauthorized, illegal and irregular use of biological resources and its components or the traditional knowledge associated to them for its application in processes of investigation and development of new pharmaceutical and industrial, cosmetic, nutracéuticos products, improved seeds, among others.

Biopiracy verifies specially when by means of patents of invention in the biotechnological field there is a direct or indirect appropriation of these resources and knowledge. Being Peru one of the megadiversos countries of the planet with an enormous potential by the biological diversity that has and aprote intellectual of its indigenous towns, this phenomenon is particularly excellent. The cases of patents granted in the outside on the maca, yacón, blood of degree, nail of cat, hercampuri, among others, do not make but demonstrate the gravity of the problem.
